SUBJECT:                                 Chapter 2, Section 253, Integrated Resource Planning - Docket No. 90000-107-XO-09 (Record No. 12032).

 

NATURE OF RULES:                     Legislative and procedural/

 

STATUTORY AUTHORITY:         W.S. 37-3-112.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:        The rules provide that electric and natural gas public service utilities doing business in Wyoming must file with the Commission an integrated resource plan from another jurisdiction if the utility was required to file in the other jurisdiction.  The Commission may require another integrated service plan be filed if the Commission determines it is in the public interest.

 

FINDINGS:     The rules appear to be within the scope of statutory authority and Legislative intent.

 

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
