SUBJECT:                                 Chapter 2, Services for Miners.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 30-6-102(b)(iii).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The State Miner's Hospital Board administers a program of benefits for Wyoming miners with work-related injuries/disabilities who have no other insurance or third party reimbursement source for their injury/disability.  These amendments to existing rules:

•  provide that benefits are available if the injured/disabled miner is a current resident of Wyoming and was injured while working in Wyoming or a contiguous state;

•  specify the type of evidence that is accepted to prove an injury in Wyoming, inability to work and lack of other insurance coverage;

•  increase the maximum annual medical benefit from $1,000 to $5,000;

•  increase the maximum hearing aid benefit from $1,000 to $2,000.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
