SUBJECT:                                          Chapter 1, General Regulations; Chapter 2, General Provisions for Educator Licenses, Endorsements, Permits and Authorizations; Chapter 3, Terms and Conditions for Educator License Endorsements; Chapter 4, Program Approval Standards for Endorsement Areas;  Chapter 5, Exception Authorizations; Chapter 6, Permits; Chapter 7, Coaching; Chapter 8, Renewal Requirements for Educator Licenses and Permits; and Chapter 9, Due Process Procedures.

 

NATURE OF RULES:                                  Legislative, procedural.

 

STATUTORY AUTHORITY:                       W.S. 21-2-802.

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  The rules being amended govern the licensing of school personnel.  The previous rules of the board, consisting of 18 chapters, were significantly revised and reorganized throughout into this new set of rules, chapters 1 through 9.

 

Chapter 1 of the new rules provides general definitions as used in the rules.  Chapter 2 provides the requirements for educator licenses including application requirements and the acceptance of licenses from other states.  Chapter 3 of the new rules provides the requirements for license endorsements.  Chapter 4 establishes program approval standards for endorsement areas and includes a table listing certain endorsement areas and the applicable standards and provides additional standards for certain endorsement areas.

 

Chapter 5 of the new rules provides requirements for exception authorizations for teachers without a required passing test score or who are teaching without endorsement in an area where they are seeking endorsement.  Chapter 6 provides general requirements for certain educator permits.  Chapter 7 establishes the requirements for coaching endorsements and coaching permits.  Chapter 8 provides the requirements for the renewal of licenses and permits under the rules.  Chapter 9 provides the due process requirements applicable to the rules including the application review process and the formal hearing process.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
