SUBJECT:                                 Chapter 1, Access to Records.

 

NATURE OF RULES:  Legislative and procedural.  

 

STATUTORY AUTHORITY:  W.S. 16-4-202(a), 16-4-204(d)        

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:  These newly adopted rules govern access to public records maintained by the Department of Workforce Services, pursuant to general authority for all agencies contained in the Wyoming Public Records Act.  The rules provide:

•     applicable definitions, including  "Non-fee Requests" and "Privileged and confidential records";

•     fee schedules for copies, employee time and postage;

•     procedures for assessment and collection of fees;

•     exceptions to fees for requests by governmental entities.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
