SUBJECT:                                 Chapter I, Purpose of Standards; Chapter II, Application of these Standards; Chapter III, Location of Wells; Chapter IV, Construction of all Wells; Chapter V, Standards for Special Situations; Chapter VI, Completion and Maintenance of Wells; and Chapter VII, Penalties.

 

NATURE OF RULES:                     Legislative, Procedural

 

STATUTORY AUTHORITY:         W.S. 41-3-909(a)(i)

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28‑9‑103(d).  No comments have been received to date.  Otherwise, procedural compliance is apparently complete to date.

 

SUMMARY OF RULES:  Generally, these new rules are being promulgated in response to 2008 HB0055, Water well drilling and pump installation licensure and to reorganize and revise these chapters.  More specifically, Chapter 1 – Contains the majority of the information previously found in Chapter 2.  It explains the purpose and scope of the rules and identifies the authority of the State Engineer.

 

Chapter 2 – Contains the majority of the information previously in Chapter 1.  It provides statutory requirements and definitions.

 

Chapter 3 – Provides well construction requirements, including water well siting, water well construction and water well equipping.

 

Chapter 4 – Requires disinfection of well components, provides for spring developments, water well rehabilitation, water well plugging and abandonment and addresses water quality.  The revisions and additions include the annular space and grouting requirements for wells.

 

Chapter 5 – Provides updated appendices, including a disinfection table, conversion tables, well types and schematic diagrams.

 

Chapter 6 – Became part of Chapter 4 and is therefore repealed.

 

Chapter 7 – Is repealed.

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
