SUBJECT: Chapter 5, Exception Authorizations; and Chapter 8, Renewal Requirements for Educator Licenses and Permits.

NATURE OF RULES:                     Legislative, procedural

STATUTORY AUTHORITY:         W.S. 21-2-802

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

SUMMARY OF RULES:  The rules are amended in chapter 5 by providing a process for an exception authorization for administrators, school counselors, school social workers, school psychologists, speech and language therapists and other related service positions.  Previously the rules provided that an exception authorization for those positions would only be issued under rare and exceptional circumstances.

Chapter 8 of the rules is amended to specify that renewal credits for an educator license or permit must be earned within the validity dates on the certificate or permit.

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
