STATUTORY AUTHORITY: W.S. 33-21-122(b) and (c)
DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.
SUMMARY OF RULES: The rules being amended govern the practice of nurses in Wyoming. Chapter 1 of the rules is amended by revising the duties of the board of education, adding and revising the definitions applicable throughout the rules and making other technical changes. As specifically noted in the comments and agency response, the definition of "supervision" was revised to require the physical availability of a supervisor. Chapter 3 of the rules is amended by revising how nurses may administer intravenous therapy. Chapter 7 of the rules is amended by adding new certifications for a certified nursing assistant II and for a medication assistant-certified and establishing the requirements, education, training and functions of those new certifications.
FINDINGS: The rules appear to be within the scope of statutory authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
