SUBJECT:                                 Chapter 18, Major Industrial Classifications.

 

NATURE OF RULES:                     Legislative.

 

STATUTORY AUTHORITY:         W.S. 27-3-503(f), 602(a)(i)

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:              Apparently complete to date.

 

SUMMARY OF RULES:        The Department of Employment, Unemployment Tax Division, administers the collection of unemployment taxes, or "contributions," from employers.  Contributions include a base rate and an experience adjustment   New employers without a claims experience pay the average rate for employers in the same industrial classification.  The purpose of this amendment is to divide the industrial classification entitled "Goods Production" into two classifications called "Construction" and "Manufacturing" so that the high unemployment rate in the construction industry is not unfairly applied to new employers in the manufacturing industry.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:         That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
