AGENCY: Department of Health.

DATE SUBMITTED: November 19, 2010.

SUBJECT: Chapter 15, Grants Assistance Pilot Program (Repeal).

NATURE OF RULES:                     Legislative and procedural.

STATUTORY AUTHORITY:         W.S. 9-2-2703 (repealed).

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

SUMMARY OF RULES:        W.S. 9-2-2703 was enacted in 2002 and included in its terms a repealer provision effective July 1, 2004.  The statute created a Grants Assistance Pilot Program as part of the statewide Substance Abuse Control Plan.  The Department's implementing rules for the pilot program are being repealed because the statutory authority for the program has been repealed.

FINDINGS:   The rules appear to be within the scope of statutory authority and legislative intent.

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
