AGENCY:                                 Board of Outfitters and Professional Guides.

 

DATE SUBMITTED:                   December 21, 2010.

 

SUBJECT:                                 Chapter 2, Licensing Provisions; and Chapter 5, License Fees.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 23-2-410(a)(ii) and 23-2-413(b)(iv)

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.

 

SUMMARY OF RULES:        The rules are amended to require all new applicants for outfitter and professional guide licenses after July 1, 2011 to provide proof of certification in first aid and hunter safety.  New applicants for outfitter licenses will also be required to attend a training course offered by the Board.

 

The rules also delete contradictory language regarding the time of validity of licenses and clarify that application fees are non-refundable.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
