NATURE OF RULES: Legislative and procedural.

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO: Apparently complete to date.
SUMMARY OF RULES:
Last year, when the Public Service Commission promulgated these rules relating to quality of service for telecommunications services, the commission received several public comments that could not be incorporated into the rules at that time. These rules provide for those comments.
These rules clarify that quality of service requirements do not apply to wholesale purchasers of elements or services pursuant to interconnection or wholesale agreements. They also do not apply to intrastate tariffs for the purpose of resale.
These rules also provide that a service or repair call must be answered by a live operator within sixty seconds after the customer selects the appropriate menu option.
FINDINGS: The rules appear to be within the scope of authority and legislative intent.
STAFF RECOMMENDATION: That the rules be placed on the Consent List and be approved by the Council as submitted by the agency.
