SUBJECT:                                 Chapter 2, Commission Rules; Chapter 3, Appeals, Protest & Hearing; Chapter 4, Information Practices; Chapter 5, Officials; Chapter 11, Cutter & Chariot Racing.

 

NATURE OF RULES:                     Legislative and procedural.

 

STATUTORY AUTHORITY:         W.S. 11-25-104(e).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION SUBMITTED BY THE AGENCY TO LSO:   Apparently complete to date.

 

SUMMARY OF RULES:  The amendments to Chapters 2, 3 and 5 of the rules clarify that the rules of the commission apply to all permitted pari-mutuel events rather than specifying horse racing.  The rules also clarify the application of the rules to persons handling all animals used in permitted pari-mutuel events.  The rules lower the age of persons who may not be permitted in betting areas to persons less than eighteen years of age. 

 

The only changes to Chapters 4 and 11 were formatting changes.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
