SUBJECT:                                       Chapter 3, Disposal Procedures for Lands Held in the Name of Wyoming SPCR.

 

NATURE OF RULES:                   Legislative and procedural.

 

STATUTORY AUTHORITY:        W.S. 36-4-106(g).

 

DETERMINATION OF PROCEDURAL COMPLIANCE BASED UPON INFORMATION

SUBMITTED BY THE AGENCY TO LSO:  Apparently complete to date.  Notice of the proposed adoption of new rules was provided by the LSO as required by W.S. 28-9-103(d). No comments have been received to date.

SUMMARY OF RULES:  These rules set forth procedures for de minimus disposals of state parks lands.  The rules restate the requirements for such disposals set out in W.S. 36-4-106(g).  The rules provide for methods of sale and processing of bids on the sale of those lands.   Additionally, the rules provide for the removal of a designation on lands held as an outdoor recreation area or facility.

 

FINDINGS:  The rules appear to be within the scope of statutory authority and legislative intent.   

 

STAFF RECOMMENDATION:  That the rules be placed on the Consent List and be approved by the Council as submitted by the Agency.
