Harshman: intent of sponsor out of July 1, 2015 contingency fund? Stubson: yes Burkhart: Clarification of motion. Do you have a similar division of the amount by year? Stubson: no Connolly: Amend the motion to bring it to zero. Not impressed with dept. outline of plan. Gov rec denial was due to no statewide plan. Wait a year, have dept. come in with a full plan about studies to be done. Ross: We have lost our director. How quickly can we move? Stubson: Against the motion. Coal ports Ross: Motion to amend failed. Ross: original motion down to 250,000. Motion to amend gov rec adopted. Motion gov rec as amended adopted. Agency 32 closed 1/21/2015 5:59:56 PM Ross: Agency 45 Gov rec 336,000 GF, 84000 highway funds for Wyolink. Burns: move the gov rec Stubson: move to amend and move it into July 15 contingency fund Burns: friendly amendment Ross: approve gov rec, move to 2015 adopted. Gov rec as amended adopted. Ross: 54 M for passing lanes. Highway 59 Perkins: gov approval of 21.9 M Ross: 21.9 GF for passing lanes Wasserburger: amendment – read by Wasserburger. Plan for lanes, sept 15. Highest priority for highway dept. in 2016, Ross: amendment vetted by Del McOmie at DOT Burns: amendment to divide the amendment. Division 1 everything to 2/3 of the motion, down to JAC and transportation committee by Jan 15. Stubson: proposed amendment to division 1. Highway 59 and US 20-26. Change sentence to highway 59 and 20-26. Friendly amendment Ross: first division. Greear: Question about the amendment Wasserburger: talked to DOT, using federal funds. Greear: better to take safety money and use for the design of 59 passing lanes. Would like to get into the design phase this summer. If we leave it broad, we may have rumble strips and turnouts but not passing lanes. Wasserburger: Design is for 21 passing lanes. Greear: each passing lane is x million. Design cost per lane. Have any funds out of their safety funds to do all the design and other projects? Wasserburger: can’t answer, would like to design them all this summer Greear: want to make sure they get designed. Ross: That was the discussion with the Gov and DOT. Greear: uncomfortable we do not get it in writing. Harshman: can get more descriptive. Ross: division 1 as amended adopted Ross now on division 2 , DOT highest priority Burns: against the amendment. Division 2 Wasserburger: in favor of the amendment. Accidents and deaths on highway 59. State dollars given to independent commission have been done in the past. This is a huge issue, in area of state that puts a lot of money into this state. Funds given to DOT should be for highway 59. Nicholas: Eliminating the 21 M from GF and it will come from Federal funds. What is the funding source? Ross: Gov rec did not get a second Greear: Stubson amendment to include us 20-26 Wasserburger: Amend division 2, insert Natrona and Fremont County. Ross: second division amendment Wasserburger: clarified the language Connolly: will vote against the amendment. What about the contiguous counties? First sentence of division 1 gives the dept. the mandate to mitigate impacts. Dept. decides on counties. Burkhart: Share concerns. Term highest priority does not allow discretion for the dept. Burns: against this part of the amendment, giving priority already to highway 59. This is DOT money. They have a process in place. It is politically independent. In first portion of motion, nudge dept. to give emphasis. Second part opens door to political meddling. Exercise of political power. Wasserburger: favor of amendment. Highway 59 has highest death rate. I do not understand why it wasn’t the highest priority. Why was it left out? Moniz: Original budget request from DOT was to address those two highways. When we address the funding of this, we are addressing those two highways already. Wasserburger: As it stands now, there are no funds. We denied the gov rec. Safety issue. Ross: Division 2 – show of hands. Portion of amendment not adopted Harshman: 3 million in severance tax acct which Gov line item vetoed. It has been used for these types of things. Propose taking 2M for 19 passing lanes. 100, 000 for each passing lane. 1.9 M. GF asked for by the dept. so we have money to get the design gong right now. Second part of amendment, non-compliant DUI law. 13 M referenced earlier. Amendment to say dept. can use that or like amount to put towards these projects. 1/21/2015 6:22:29 PM Harshman: agree with everything said. Can move it faster and get things going. There is not one passing lane on highway x. (by wright). Ross: not clear on what you are doing. Provisions on open container.. Monies are not necessarily accessible because of the way it was written Hibbard: open container law. Congress wants us to have more stringent laws so they divert money from core highway funds to safety . Most of that money has traditionally gone to safety on the highways like guard rails and passing lanes. It is about 10 M per year from those diversions. It in the SIP and available to the dept. to use those funds. Ross: against the motion. Dept. believes they have ability to do design work with the funds currently available so putting 100,000 for each lane does not expedite the process. Greear: My understanding is WYDot had already found the money. 15 lanes on 59. 5 between Casper and Shoshoni. Start design work on those. Nicholas: Against the motion. All issues have been discussed with DOT. We could amend the previous component passed and add in that it will be used for those passing lanes. Harshman: I do not have that in my notes. Mine say it was an alternative if we choose to fund it. It is not in my notes. Amendment number 1 does not direct them to do anything. Nicholas: folks have met with DOT and they have found the funds. Am I wrong? Wasserburger: That is how I took it and I think the Chairman also. Greear: won’t get lanes done until 17 M because it is federal funds Ross Harshman: They swap federal and state funds all the time. Wasserburger: my vote is to support the amendment just to be safe. Expectation in mineral industry that the state will take care of this. Nicholas: Waffling from directive given to DOT. Harshman: can’t say you don’t want them to use federal funds, then give them the option to swap funds. No impact on Golden rod or GF. No money to come back and say we are going to put another 20 M into WYDot. Burkhart: repeat please Harshman: Take the 20 passing lanes and 10% amount is 20 M for design. That is cash we have. Severance impact funds have 3 M. Take 2 M out of impact funds to get the design going. Direct WyDot to use their safety funds of 10 M or a like amount of state funds to get this started. DOT has a different fiscal year than we do. Ross: Seven hands. Motion passed. Richards: Gov rec does not need a second so need to take to zero. Ross: motion to take to zero passes. 1/21/2015 6:33:29 PM Richards: 815000 for bridge in Evansville. Harshman: more info on that. Stubson: right. 4.2 M project with 815 for the design. Relates to Evansville, which only has one road out transacted by a major rail line so if safety issue. Stubson: I move that we fund the 815000 planning out of the 1 M left in the severance impact funds. Perkins: Explanation of the highways and rail lines. Population growth in Evansville. Burns: west or east of I 25 Perkins: north of I25 Burns: bridge over the platte? Perkins: Crosses river to the north Harshman: Bar Nunn is the fastest growing community in the state. Evansville is in the top 5. Bar Nunn is being fixed through an MPO. There will be an interchange. Burns: the new exchange for Evansville will be north of the current exit but south of northern lights Harshman: talking about two important projects. Ross: MPO-metropolitan Stubson: Also private money Ross: Motion on Evansville bridge Hastert: wyoDot project? Stubson: It is on list but years down the road. Hastert: Bypass road between Green River and Rock springs – issue years ago. The road was on wydot list but was way down the list, years ago. Told constitution……This could be construed as special legislation. Burns: Could the same thing be said about highway 59. Hastert: no because that came from WyDot. Ross Stubson: Motion to design the Evansville plan and take money out of the remaining funds from the line item veto, funds reflected in gov letter six Ross: Amendment. six hands. Motion failed 1/21/2015 6:44:35 PM Richards: 10% sales tax. When passed there were 3 items in a footnote for use of the tax. Harshman: Statute was written only for 13-15. I think we want to make sure funds are accounted for separately. Ross: maintenance portion sunsets in 2016. Ross: motion is first two Richards: separately accounted for and reported on to Joint transportation Ross: Motion adopted Ross: gov rec as adopted. Nicholas: Motion on Evansville Bridge, amendment similar to the one crafted by Wasserburger. It is a directive. Ross: it is a city street. Nicholas: never mind. Ross: Motion to close dept. 45 – adopted. Dept. closed Ross: progress? Richards: halfway through the budget but have gov letters and capital constructing. Ross: tomorrow morning and noon. We also have Friday. Richards: All day Friday available. Will continue. 1/21/2015 6:49:12 PM Dept. 48 Dept. of health. Ross: Priority 2 –page 8 in book, provider rate rebasing study for 250,000 Burns: 125000 GF and 125000 x funds Ross: Gov rec ADOPTED 1/21/2015 6:51:00 PM Ross: Nursing home rate model. Gov rec of 4 M in GF to be matched with like amount in fed funds Perkins: Move to modify gov rec by reducing by one half. Would still have fed match Perkins: Need to do rebasing. This is recurring money so this amount will roll out double in the next biennium. If the revenue picture would be different, I would vote different. Burns: I read it that this is money spent every 2 to 4 years for the study of the rebasing. Probably will result in a higher rate. Greear: This is increasing the rates. 4.5 will be 9 in the next budget. Ross: Motion to take down one half Connolly: resist the motion. Narrative. Beginning rebasing below the mean Stubson: That is without the provider tax so with this amount, not starting out behind the eight ball. Ross: Motion to amend has passed. Ross: Gov rec as amended has passed. Richards: Three footnotes. Existing #4 provides 100,000 for hearing aids for early childhood intervention. Request to expand the age from birth to 21. 1/21/2015 6:56:39 PM Hastert: It was catching school age children only. Intent not to expand the program. Motion is for hearing aids for birth through completion of high school. Ross: many kids do not complete high school Hastert: it was intended for school age children Perkins: clarification – footnote before was DD waiver, would remove that Richards: not waiver program. It was preschool. Would remove developmental disability, would make it for all school age children. Ross: of the 100,000 how much has been accessed. Hastert; I do not know the total amount. Discussion. Ross: amend footnote number 4 to include all school age children. Amendment passed. Nicholas: do we want to restrict it to high school kids in need as opposed to anyone. Hastert: You have to see a hearing aid specialist to be diagnosed. Nicholas: Insurance? Hastert: Most insurance policies do not cover hearing aids. Ross: is it means tested at all? Based on their income? (in relation to federal poverty levels) Hastert: Hands and voices, not sure. Can add a means assessment. Perkins: Remind the body of attempt to make hearing aid coverage mandatory under insurance, was rejected by legislature. When you expand, it will be difficult to pull back. Deaf, dumb and blind account which is earning interest. 1/21/2015 7:04:00 PM Richards: 1 m GF matched by 1 m fed funds to increase provider rates for adult based care Nicholas: Rebasing on adult disability waivers this summer. DD providers going out of business. Average pay is between 9 and 10 dollars per hour. Bill in front of house for 1 M to study the issue. Federal regulations changing how to care for these adults. 2.5 M reduced to 1 m in funds today on the HB. Those funds are to help transition of the providers to follow fed regs and implement them. Instead of spending a million on changing over a one or two year period. They need money to get by so they don’t go out of business. When we do the rebasing, the study will come up with 4+ M. Instead of funding for 1 M to teach these providers, give them 1 million to bridge the gap until the rebasing is done. Attempt to eliminate the bill asking for the 1 Million, that is in the house. Better use of the funds. I move the amendment. Perkins: What type of increase? Nicholas: dept. of health says between 6 and 10 M. It is not likely we will fund all of it. It will be significant. Perkins: Will this increase the wage rate and how much? Nicholas: 624 providers with 1 to 264 employers, so I don’t know. Dept. of health will take the 1 m and distribute based on the current model. Ross: one time funding or built in Nicholas: one time funding. Rebasing will be in the next budget session. Harshman: last sentence in the amendment. My understanding is that this would be a down payment on the rebasing. Nicholas: I like what you said. I put in the last sentence because the feds need to know it is not one time, so there would be a match. Greear: Dept. stated it cannot be one time funding. Richards: ways to clarify the ongoing nature of the funds in that last sentence. Nicholas: I will work with Don and Dept. of health. Greear: Increase the fed funds and GF by 500,000 and make it contingent upon HB 58 failing and not being enacted. Ross: take down? Greear: no increase Ross: motion to amend the amendment from 1 M to 1.5 m contingent on HB 58 passing Greear: no HB failing, just the 500,000 contingent on that bill failing. Ross: Amendment to the amendment passed Harshman: Move to strike the last sentence of the amendment. Indicate this payment is down payment on the rebasing. It will not create a new base for the rebasement to be funded upon Ross: Amendment to amendment Adopted. Harshman: clarification of 1.5 M Nicholas: if HB 58 fails Ross: twice amended amendment ADOPTED 1/21/2015 7:16:32 PM Hastert: Application form includes needs testing. Info from voice and hands. Perkins: says payment not from other source Hastert: yes they check availability 1/21/2015 7:17:40 PM Richards: Two more to health care financing. Footnote six prohibits a cost of living increase in other rates unless there is other language. Will strike the language. 1/21/2015 7:18:20 PM Richards: hospice rates did not go up 77.70 per day. It is not like crisis beds. It is only if bed is filled. Consider increase to 125 183585 GF Perkins: My motion. I would amend. Hospice is half of the day rate of a nursing home. Should be proportionate to the nursing home rate. Increase the hospice residential rate in proportion to the amount we increased the nursing home rate. Perkins: Duke study on death of individuals. 7500 savings for hospice care. No emergency services, preparing for death. Fiscal note shows cost neutral. Ross; Recurring Perkins: yes, like rebasing Burns: I understand the increase, dollar amount Richards: the 183,000 had nothing to do with the nursing home rate. Increase of 11000+. Ross: Section 0401. Inc by 2.3% the rate for hospice. Motion passed. 1/21/2015 7:23:08 PM Nicholas: primary care support for rural hospitals. Richards: later in the public health Harshman: confirm that we have 125000 for rate study 2.3 M, 11,000 for hospice. Did we address the preschool second year maintenance. Ross: have not gotten there yet Harshman: assume out of immediate available funds, not contingency Ross; yes. Closed 1/21/2015 7:24:30 PM Ross: Section- public labs. Gov rec of other funds. Public health laboratory. Gov rec adopted Richards: Opportunity for Nicholas. Nicholas: 2013 bill passed. Community health centers in small communities underserved, rural health care clinics. Monies were taken. Funds must be approved by county commissioners, 25% community match. Via footnote add 200,000 second tier funds, July 1, for rural care clinics to apply for these funds for ongoing projects. Projects were submitted but denied because of no funds. Ross: 200,000 in GF contingent July 1, 2015 Nicholas: 2015 – contingent on cash in kind Connolly: How many communities were served by the original grant? How many by this amount Nicholas: the 1 million went to Big Horn basis, Powell, Evanston, south Cheyenne basically 4 communities. I do not know where the other applications were from Ross: Motion passed. Stubson: Motion- public health program. State provides 65% of public health nurses cost . Two counties have paid for their services in entirety. Natrona County and Sweetwater County . The amount provided was significantly short. Need 1.36M, split between the two counties, to bring them up to par. Ross: Immediately available funds? Stubson: yes Hastert: It was never fully funded. Reasons for two counties doing that explained. Ross: Richards: We provided rep Stubson with inaccurate info. Amount is lower 1.1 M, not 1.36M Stubson: Bargain at 1.11M Richards: Campbell, Natrona and Sweetwater- Agar: Need a clarification of two or three counties Stubson: 3 counties is the 1.36 M? Stubson: motion for all 3 counties Ross: recurring Stubson: yes Burns. Doubled? Harshman: It is not doubled because it is about 15 or 16 months of funding. Moniz: amount for 3 counties? Richards: 1.36 M, 835000, 835000, 94500 for Natrona county Hibbard 15.3 M. Sweetwater and Natrona were give ability to use their salary savings currently. Nicholas: move to reduce it in half. Ross: down to 800,000 motion failed. Ross: back on original motion for the 3 counties. Motion failed. Nicholas: New motion to make it 800,000 Stubson: clarification. To be split proportionately? Nicholas: yes Ross: Motion adopted 1/21/2015 7:38:22 PM Ross: gov rec on lab, still moving 1/21/2015 7:38:53 PM Ross: Preschool services – gov rec Stubson: amendment to reduce down to 517,472. Dept. of health. We had appropriation for maintenance of effort for one year. Changes in child count numbers. Indicated total funding requirement was 69 M. Appropriate all but the 517742. Greear: once you raise the bar, you cannot lower it except for number of children. Ross: Burns: move to amend up to 800,000 Connolly: reason Burns: safety margin Stubson: problem is with that is that will be the level we will have to hold, cannot reduce Connolly: share concern of Senator Burns . It sounds like we don’t really know. Stubson: When we did the 1.6 M, it dated back to the last budget session and we did not know so funded for one year. Now we do know. Hastert: dept. of health letter is the exact figure. Ross; Burns motion is failed. Ross: Motion to reduce to 217472- motion passed. Ross; gov rec as amended is passed Hastert: Medicaid expansion into footnote..joke Richards: Senator Perkins motion may be 12000 off, would like discretion to be accurate. Perkins; fine with me Ross; conceptual, fine Harshman: motion. Part b and c in the preschool. Administered differently than the other 49 states. Motion is to get a working group or study group from dept. of health and dept. of education to know the best way to administer that. No funding. Richards: Prepared as part of a section 300 Connolly: major issue with title 25 detention costs. Where is the appropriate place for that. Ross; gov letter Ross; Agency 48 is closed Finished for the evening Hastert: would like total in the morning. Rep. Harshman chairs tomorrow, will move on. 1/21/2015 7:47:51 PM
