Confidentiality Requirements

W.S. 28-8-107(d) requires contents of a program evaluation report to be confidential until formally released by the Management Audit Committee. Members of the Committee, LSO employees, and employees of the entities being evaluated cannot disclose report findings and other information until the Committee formally releases the report. Further, statute (W.S. 28-8-108(a)) specifies that the information obtained by LSO evaluators in preparing a report is not a public record, and therefore must remain confidential information in the possession of LSO. This means that the working papers and documented information used to prepare the report are available only to the LSO program evaluators, who keep the information confidential even after the report is released.
